Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Tulu Identity platform and its identity (digital credentials) verification services (the "Service"). These Terms form a binding agreement between you and Tulu Identity with respect to your use of our website, application, and related services.

Tulu Identity provides digital identity verification services designed to verify your identity by collecting and processing personal data — including government-issued IDs and other relevant data — to enable secure authentication and reduce fraud and forgery.

By registering an account and providing your personal data, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms, you must not use the Tulu Identity platform.

2. Eligibility and User Registration

2.1 Individuals

By registering to use our Services, you represent and warrant that you are at least 18 years of age, possess the legal capacity to enter into this agreement, and are not prohibited from using the platform under any applicable law. You agree to provide accurate, current, and complete information when requested.

2.1.1 KYC and Identity Verification

All individual users must complete a KYC verification process before accessing full platform functionality. You agree to provide:

  • Full legal name and date of birth
  • Valid government-issued ID (e.g., National ID, Driver's License, International Passport)

We reserve the right to decline, suspend, or terminate your account if we are unable to verify your identity or if your KYC information is found to be false, incomplete, or misleading.

2.2 Institutions

Institutions may register on the platform in their corporate capacity. The institution must be duly incorporated, possess the legal capacity to enter this agreement, and agree to verify and issue digital certificates to end users in accordance with our Privacy Policy.

2.3 Developers and Validators

Developers must demonstrate technical expertise relevant to the Tulu Identity platform. Validators must have a strong background in verification or compliance and be recognized by their professional body or overseeing institution.

3. Account Creation

Upon successful KYC verification, you will be provided with:

  • A unique Tulu Identity Number or PIN for authentication
  • A Wallet with Public Key and Private Key
  • A Decentralized Identifier (DID)
  • A QR code/scannable link for instant verification

You are solely responsible for maintaining the confidentiality of your login credentials, restricting access to your devices, and immediately notifying Tulu Identity of any unauthorized use or breach of your account security.

3.1 Acceptable Use

All users agree not to:

  • Violate applicable laws or infringe on intellectual property rights
  • Spread hate speech, misinformation, or harmful content
  • Exploit the Service for fraud or impersonation
  • Reverse-engineer or disrupt the platform's functionality

3.2 Fees and Charges

Tulu Identity may apply fees in connection with the use of its platform. All fees will be debited in real time or at settlement. An up-to-date fee schedule is available within the Tulu Identity app or on our website. Continued use of the Service constitutes acceptance of any updated fee terms.

4. User Responsibilities

By creating a Tulu Identity account, you agree to:

  • Create a strong, unique password and keep your PIN confidential
  • Immediately update credentials if you suspect they have been compromised
  • Log out of the application on shared or public devices
  • Not create multiple accounts to bypass onboarding and verification
  • Not use automation or bots to conduct unauthorized activity
  • Not reverse-engineer, modify, or tamper with any part of the Tulu Identity platform

Violation of this section may result in immediate termination of your account and referral to law enforcement or regulatory bodies.

5. Suspension, Freezing, and Termination

5.1 Right to Suspend or Freeze Accounts

Tulu Identity reserves the right to suspend, limit, or freeze access to your account without prior notice if suspicious activity is detected, KYC information is found to be false or unverifiable, or we are directed to do so by a regulatory authority or court.

5.2 Termination by User

You may deactivate your account at any time by submitting a request through our in-app support or via email. You remain responsible for any legal or compliance investigations related to your prior activity.

5.3 Termination by Tulu Identity

We may permanently terminate your account for severe or repeated violation of these Terms, use of Services for fraud or illegal activities, or non-cooperation with risk assessments or investigations.

6. Limitation of Liability and Disclaimers

Tulu Identity provides access to its platform on an "as-is" and "as-available" basis. We do not guarantee that the platform will be uninterrupted, secure, or error-free. To the fullest extent permitted by applicable law, Tulu Identity shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data.

7. Data Protection and Privacy

Tulu Identity is committed to protecting the personal data of its users in compliance with international best practices and regulations. We store data securely using encryption at rest and in transit, access controls, and privacy-by-design infrastructure hosted on compliant cloud platforms (e.g., AWS).

8. Dispute Resolution and Governing Law

8.1 Internal Resolution First

Users agree to first contact Tulu Identity via the official support email or in-app dispute resolution channel to resolve any complaints. We commit to responding to all legitimate concerns within five (5) business working days.

8.2 Legal Escalation

If a dispute cannot be resolved informally within fifteen (15) business working days, it shall be referred to arbitration. The decision of the Arbitrator shall be final and binding. Either party may seek interim injunctive relief in a court of competent jurisdiction where necessary.

9. Amendments to Terms

Tulu Identity reserves the right to modify these Terms at any time. Users will be notified of significant changes via in-app notifications, email, or a notice on the official website. Unless otherwise stated, revised Terms become effective seven (7) days after notice is issued. Continued use of the platform after the effective date constitutes your acceptance of the updated Terms.
